App Privacy Policy

This Privacy Policy is effective as of July 1, 2015.

Nack is a mobile software application owned and operated by Kaneland, LLC (“Kaneland”).  Kaneland considers user privacy to be important and is committed to providing appropriate safeguards.  This Privacy Policy will help you understand our approach to privacy and assist you in deciding whether to use Nack.

Collecting Personal Information

 Kaneland may collect, store and use the following kinds of personal information:  your name, address, gender, e-mail address, information pertaining to public groups you choose to affiliate with, lifestyle preferences, food preferences, purchasing history, gifting history, location (if you choose location services necessary for gifting), information relating to Nack usage and any existing social network information gathered through Nack’s connection to social networks.

Kaneland does not knowingly collect or use personal information about users under the age of 13.  You must be at least 13 years old to use Nack.

Using Personal Information

Kaneland may utilize your personal information to:  administer Nack, operate Kaneland and enable you to utilize Nack; send you coupons and information about promotions; enable you to make gifts to third parties; provide updates, send notifications, announce changes to User Terms and this Privacy Policy; deliver marking materials and deal with inquiries made by you relating to Nack; verify compliance with User Terms and other rules and conditions governing the use of Nack (including monitoring private messages sent through Nack); take steps deemed reasonably necessary to keep Nack secure and to prevent fraud; and provide third-parties with statistical information about users (but we will not disclose to those third-parties information that would allow them to identify any individual users from that information).

Disclosing Personal Information

Kaneland may disclose your personal information to third parties insofar as reasonably necessary for the purposes set out in this Privacy Policy.  We may also disclose your personal information to the extent that we are required to do so by law, in connection with any ongoing or perspective legal proceedings in order to establish, exercise or defend Kaneland’s legal rights (including providing information to others for purposes of fraud prevention and reducing credit risk), to the purchaser (or perspective purchaser) of any business or asset that Kaneland is (or is contemplating) selling, and to any person who Kaneland reasonably believes may apply to a court of competent authority for disclosure of that personal information where, in Kaneland’s reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information.  Accept as provided in this Privacy Policy, Kaneland will not provide your personal information to third parties.

Retaining Personal Information

Kaneland works to comply with its legal obligations to safeguard your privacy and has developed a data retention policy and procedure which is designed to insure that it complies with its legal obligations in relation to the retention and deletion of personal information.  Personal information that Kaneland processes for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.  Without limiting the foregoing, Kaneland will retain documents (including electronic documents) containing personal data to the extent it is required to do so by law, if Kaneland believes that the documents may be relevant to any ongoing or perspective legal proceedings, and in order to establish, exercise or defend Kaneland’s legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).


We strive to use commercially reasonable and acceptable measures to prevent the loss, misuse or alteration of personal information.  We continually implement security measures designed to protect your personal information from unauthorized access.  All personal information will be stored on our secured (password – and firewall protected) service.  Despite our best efforts we cannot guarantee security.  By using Nack, you acknowledge that you understand and agree to assume the risks associated with potential security breaches.

Your Rights

You have the right at any time to prevent Kaneland from contacting you for marketing purposes.  When Kaneland sends a promotional e-mail to a user the user can opt-out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail.  Due to the delays inherent in software technology it may take several days for this to take effect.  Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in the Settings section of Nack, Kaneland may continue to send you administrative e-mails including, for example, periodic updates to the Privacy Policy.

Links To Other Websites and Advertising on Nack

Nack may contain links to third-party websites, applications or access to resources such as coupons, menu selections, brand names, products and other goods, supplies and services. We have no control over, and are not responsible for the privacy policies and practices of third parties.  This Privacy Policy only applies to Nack.  You acknowledge and agree that Nack and any of its business partners are not responsible or liable for: (i) the availability or accuracy of such websites, applications, resources or services; or (ii) the content, products, or services on or available from such websites, applications or resources. Links to such websites, applications or access to resources do not imply any endorsement by NACK or its employees, managers, officers, or agents of such websites, applications or resources or the content, products, or services available from such websites, applications or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites, applications or resources.  YOUR BUSINESS DEALINGS WITH THIRD-PARTIES FOUND THROUGH THE SERVICE ARE SOLELY BETWEEN YOU AND THE THIRD PARTY.

Data Location

The information collected by Kaneland will be primarily stored and processed in the United States.  Kaneland may from time to time work with contractors in foreign jurisdictions.

Changes To This Privacy Policy

Company reserves the right to change this Privacy Policy from time to time.  If we make any materials changes, we will notify you of such changes by posting them on Nack or by sending you an e-mail or other notification.

Disclaimer Third Parties

Kaneland does not sell coffee, beverages or food products. The Nack software application (which is the sole property of Kaneland) is only a tool and resource of information which enables individuals to better facilitate purchases from stores identified on the application.
